Terms and Conditions

1. Introduction

‍These Terms and Conditions govern the use of services provided by Smoky Mountain Innovations (SMI), including web development, digital marketing, and other related services. By engaging our services, you agree to comply with and be bound by these terms.

2. Payment Terms

  • Projects Under $5,000: Payment must be made in full before the commencement of work.
  • Projects Over $5,001: A minimum deposit of two-thirds of the total fee is required to begin work. The final one-third of the payment must be made before any completed work is released to the client.

3. Scope of Work

  • Work to be performed is strictly limited to the scope agreed upon before project commencement. Any additional work outside this scope will require a separate agreement and additional fees.

4. No Refund Policy

  • Once a purchase is made, there are no refunds. Clients are encouraged to review the scope of work and payment terms carefully before making a payment.

5. Project Completion and Liability

  • Upon completion and handover of the project, SMI will not be liable for any issues or damages arising thereafter. Continued updates and maintenance will only be included in the Elite Package, on a monthly retainer plan, or in projects over $10,000 for up to a year. Any updates or maintenance not due to developer error will incur additional charges.

6. Intellectual Property

  • All intellectual property rights for work created by SMI will be transferred to the client upon full payment.

7. Confidentiality

  • SMI commits to maintaining the confidentiality of all client information and project details, except as required by law.

8. Dispute Resolution

  • Any disputes arising out of or related to these Terms and Conditions will be resolved through negotiation, mediation, or arbitration, as necessary.

9. Governing Law

  • These Terms and Conditions shall be governed by and construed in accordance with the laws of the jurisdiction in which SMI operates.

10. Amendments to Terms and Conditions

  • SMI reserves the right to modify these Terms and Conditions at any time. Continued use of our services after any such changes shall constitute your consent to such changes.
